This Convention shall not apply where the address of the person to be served with the document is not known. That part of the request, in the form attached to the present Convention, which contains a summary of the document to be served, shall be served with the document. Any State may declare that it is opposed to such service within its territory, unless the document is to be served upon a national of the State in which the documents originate. Article 9 Each Contracting State shall be free, in addition, to use consular channels to singles hága documents, for the purpose of service, to those authorities of another Contracting State which are designated by the latter for this purpose. Article 12 The service of judicial documents coming from a Contracting State shall not give rise to any payment or reimbursement of taxes or costs for the services rendered by the State addressed.

Notwithstanding the provisions of the preceding paragraphs the judge may order, in case of urgency, any provisional or protective measures. A Szerződő Államok bármelyike kinyilváníthatja, hogy bírái e cikk első bekezdésének rendelkezéseire tekintet nélkül eldönthetik a jogvitát akkor is, ha nem érkezett vissza a kézbesítésről vagy átadásról szóló tanúsítvány, amennyiben az alábbi feltételek mindegyike teljesült: a az iratot a jelen Egyezményben meghatározott módok valamelyikének megfelelően továbbították; b az irat továbbítása óta eltelt egy olyan időtartam, amelyet a bíró az adott esetben elegendőnek tekint, de legalább hat hónap; c a megkeresett Állam illetékes hatóságain keresztül megtett minden ésszerű lépés ellenére semmiféle tanúsítvány nem érkezett.

E cikk rendelkezései nem képezik akadályát annak, hogy a bíró sürgős esetben ideiglenes intézkedést alkalmazzon, ideértve a biztosítási intézkedéseket is. Kifogás hiányában a csatlakozó Állam tekintetében jelen Egyezmény annak a hónapnak az első napján lép hatályba, amely a második bekezdésben említett határidők közül az utolsónak a leteltét követi.

Az ilyen nyilatkozat akkor válik hatályossá, amikor az Egyezmény hatályba lép azon Állam tekintetében, amely azt tette.

Minden későbbi kiterjesztő nyilatkozatot Hollandia Külügyminisztériumánál kell bejelenteni.
